Dahlia Lithwick is my hero

If you have time, and need a laugh, I highly recommend reading this Slate article. She covers the recent Supreme Court case Morse v. Frederick, and the article is amazing for many reasons, mostly due to the sheer number of stoner jokes she manages to fit into it. It's also an interesting case of school censorship, and raises issues of how do we consider which illegal activities it's ok to advocate for, but when it comes down to it.... It really is just a case about a kid who thought it'd be funny to put a giant sign up across from his school that read "Bong Hits 4 Jesus."

And yes, David Souter at one point asks whether or not we should think about what the phrase "Bong Hits 4 Jesus" actually means. That is now on the public record, folks.

Maybe the kid should claim he left off part of the sign. It should have said, "Bong Hits 4, Jesus 9."

I don't understand why nobody brings up the fact that, um, the sign wasn't on school property. Obviously Starr is ridiculous, save for how fracking scary he is, but it is fun to see both ends of the spectrum twist around confliting ideologies in this case. Neo-cons who want to give teachers unlimited power? Check! Liberals trying to curb the nanny-state? Check! Alito coming out in favor of the stoners to prtoect the rights of gay-bashers? Check! Nine supreme court justices bitch-slapping both counsels for dragging them into a "Bong Hits 4 Jesus" case? Very check.

I'm totally on the kid's side, BTW. Even though he's clearly a jackass, he's my kind of jack-ass. And this seems open-and-shut to me. There's no need to invoke Tinker one way or the other. He wasn't on school property, and neither was the sign. End of discussion. If you want to suspend him, suspend him for truancy. Voila.
